Welcome to Femma ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Femma platform, including our website at femma.ai and all related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must not access or use the Service.

Age Requirement: You must be at least 18 years of age to access or use this Service. This Service contains AI-generated romantic and intimate content that is intended exclusively for adults. By creating an account or using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Age Verification Measures: We employ multiple layers of age verification to prevent minors from accessing the Service, including but not limited to:

• Age-gate screen: All visitors must affirmatively confirm they are 18 or older before accessing account registration
• Phone number verification via OTP: All users must verify a valid phone number through a one-time passcode (OTP) sent via SMS during registration, which serves as an additional identity and age verification layer
• Onboarding consent: During onboarding, users must affirmatively check three separate consent boxes confirming their age, understanding of the content, and agreement to these Terms and our Privacy Policy

Misrepresentation of Age: If you misrepresent your age to gain access to the Service, you are in violation of these Terms and may be subject to account termination. You may also be held liable for any damages resulting from such misrepresentation.

Underage Users: If we discover or have reasonable grounds to believe that a user is under the age of 18, we will immediately: (a) terminate the account; (b) delete all personal information and associated data; (c) block further access from the same credentials. Any subscription fees paid will not be refunded in such cases.

Parental Reporting: If you are a parent or guardian and believe your child has accessed the Service, please contact us immediately at support@femma.ai. We will take prompt action to remove the account and all associated data.

Geographic Restrictions: The Service is intended for users in jurisdictions where such services are legal. You are responsible for ensuring that your use of the Service complies with all applicable local, state, national, and international laws and regulations.

We reserve the right to request additional proof of age at any time and to suspend or terminate accounts that we reasonably believe violate our age requirements.

Nature of Content: The Service provides AI-generated companion interactions that may include romantic, sexually suggestive, and explicit content. By using the Service, you acknowledge and agree that:

• You voluntarily choose to access and engage with this content
• All content is generated by artificial intelligence and is entirely fictional
• AI companions are not real people and do not have feelings, consciousness, or agency
• You will not hold the Company liable for any emotional, psychological, or other effects from using the Service
• You are accessing this content in a jurisdiction where it is legal to do so

Content Modes: The Service offers different content modes. Users may select an adult content mode or a safe-for-work mode. Regardless of the mode selected, you must still meet the minimum age requirement of 18 years.

Femma provides an AI-powered companion service that enables users to engage in real-time voice and text conversations with artificial intelligence characters. The Service includes:

• Real-time AI voice conversations with customizable companions
• Personalized AI companion interactions with memory and learning capabilities
• Multi-language support across 20+ languages
• Customizable companion appearance, voice, and personality preferences
• AI-generated companion images

AI Disclaimer: All interactions on the Service are with artificial intelligence systems. AI companions are not real people. Responses are generated by machine learning models and should not be considered as professional advice of any kind, including but not limited to medical, legal, financial, or psychological advice. Do not rely on the Service as a substitute for professional help.

No Real Relationships: Interactions with AI companions do not constitute real relationships. The AI does not have emotions, sentience, or consciousness. The Service is for entertainment purposes only.

To access the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Verify your phone number via SMS one-time passcode (OTP)
• Complete the age verification and consent process during onboarding
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You may only create one account per person. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised or duplicated.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to engage the AI in conversations involving minors in any sexual or inappropriate context
• Use the Service to generate content depicting, promoting, or glorifying violence, abuse, or non-consensual activities
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems, bots, or scripts to access the Service without authorization
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Share your account credentials with others or allow others to access your account
• Allow any person under 18 to access the Service through your account
• Record, distribute, or publicly share conversations from the Service without authorization
• Use the Service to harm, threaten, or harass others
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service in any manner that could damage, disable, or impair the Service

Violation of this Acceptable Use Policy may result in immediate account termination without refund and may be reported to appropriate law enforcement authorities.

Pricing: Certain features of the Service require payment. All prices are displayed in US dollars and are subject to change. We will provide notice of any price changes before they take effect.

Recurring Billing: If you purchase a subscription, you agree to recurring billing. Subscriptions are billed monthly in advance. By subscribing, you authorise us to charge your payment method automatically at the start of each billing period.

Auto-Renewal: Subscriptions renew automatically unless cancelled before the next billing date. You will not receive a separate renewal reminder unless required by applicable law.

Payment Processors: Payments are processed securely through third-party payment processors such as CCBill. We do not store your full credit card or payment details on our servers.

Free Trial: We may offer a one-time free trial. After the trial ends, you will not be charged unless you choose to upgrade to a paid plan.

Refunds: All purchases are final. Refunds are only considered in limited circumstances (duplicate charges, billing errors, unauthorised transactions). Requests must be submitted within 7 days of the charge. See our full Billing & Refund Policy.

Cancellation: You may cancel your subscription at any time through your account settings (Account Settings → Subscription → Cancel). Users billed via CCBill may also manage or cancel their subscription through the CCBill Support Center. Cancellation stops future renewals; access continues until the end of the paid billing period.

AI System: Femma is an artificial intelligence system designed for companionship and entertainment purposes only. It does not provide medical, legal, financial, psychological, or any other professional advice. Do not rely on the Service as a substitute for professional help.

Emergency Notice: If you are experiencing a mental health crisis, medical emergency, or any other life-threatening situation, please contact your local emergency services immediately (e.g., 911 in the US). Femma cannot provide emergency assistance.

Our Content: The Service and its original content, features, AI models, and functionality are owned by Femma and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

AI-Generated Content: Content generated by the AI during your use of the Service (including text, voice, and images) is provided for your personal use only. You may not commercially exploit, redistribute, or publicly display AI-generated content without our prior written consent.

Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Service, nor may you reverse engineer or attempt to extract the source code of the software or AI models.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in the Privacy Policy.

Conversation Privacy: We are committed to protecting your privacy. Conversations are processed in real-time for the purpose of providing the Service. Please refer to our Privacy Policy for complete details on how we handle your data.

Cookies: The Service uses cookies and similar technologies for essential functionality, including authentication and age verification. By using the Service, you consent to our use of cookies as described in our Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

AI Limitations: AI responses are generated by machine learning models and may occasionally produce inaccurate, inappropriate, or unexpected content. We continuously work to improve our systems but cannot guarantee perfect accuracy or appropriateness of all AI-generated content.

Not a Substitute for Professional Services: The Service is for entertainment and companionship purposes only. It is not a substitute for therapy, counseling, medical advice, legal advice, or any other professional service. If you are in crisis, please contact emergency services or a crisis helpline.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEMMA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Femma and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your misrepresentation of your age or identity
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Any content you submit or transmit through the Service

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, at our sole discretion. We will terminate accounts immediately and without notice in the following circumstances:

• Discovery that a user is under 18 years of age
• Attempts to generate content involving minors
• Violation of our Acceptable Use Policy
• Fraudulent activity or misrepresentation

Upon termination: your right to use the Service will immediately cease; we may delete your account and associated data; any provisions of these Terms that should survive termination will remain in effect.

You may terminate your account at any time by contacting us at support@femma.ai or through your account settings.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Femma regarding the use of the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral.
